The most recent data from the Administrative Office of the U.S. Courts on patent suits is for 2014. A total 5,686 patent suits were field in U.S. District Courts. This represented a 12% drop from the 6,497 cases filed in 2013, and the first decline in the number of cases filed since 2009. The years between 2009 and 2013 saw a sharp increase in the number of cases filed, which began with 2,792 in 2009. Some private organizations have reported that patent suits are rising again in 2015, but government data is not yet available.

Also in 2014, 3,693 trademark cases were filed in U.S. District Courts. This represented a 16% increase from the 3,172 filed in 2013. This was the first increase in the number of trademark cases filed since 2010.
