Another Success Made by Our Office Representing Our client in Invalidation

Recently, our Office received Examination Decision No. 15425 on the Request for Invalidation for Patent No. ZL200530092244.9 titled Ultra-thin Injection-molded Food Package (four spaces) issued by the Patent Reexamination Board of the State Intellectual Property Office(PRB).In the decision the PRB determined that the difference between the materials used by the concerned patent and the prior design pertains to substitution by using a conventional material, which has no significant effect on the overall visual effect; as to the differences in the package body and the edging lines on a perimeter of the lid body, they are minor ones in the details, which is not sufficient to affect the similarity between the overall shapes of the two products. Thus, the concerned patent and the prior design are similar designs. Accordingly, the concerned patent was totally declared invalid. Thus, a further success has been made by our office representing our client in an invalidation case.

As our office has a special division in charge of invalidation cases, and there are close to one hundred invalidation cases dealt with by our office every year, an experienced team of patent attorneys dealing with invalidation cases has been formed.
