Cracking Down on Bad Faith Filings of Guangzhou Guo Bang

Guangzhou Guobang Trading Co., Ltd. is a company located in Guangzhou City of China, who had filed a total of 458 pieces of trademark applications since 2008. Most of these mark applications are copies, imitations or plagiarism of other’s prior registered or used reputed marks primarily in the restaurants or hotels industries. In response to the bad faith filings by Guangzhou Guobang, many of the true owners of these world famous brands including Wyndham, Ritz-Carlton Hotel, ACCOR, Inter-Continental and etc. have filed oppositions against the mark applications filed by this Chinese company. Wyndham had entrusted our firm to file a total of 34 oppositions. Besides, 21 companies entrusted our firm to file a joint complaint with the China Trademark Office.

When received all necessary Powers of Attorney and drafted the complaint letter, our firm further discussed the case with all parties involved through email, teleconference and face-to-face meeting. Besides, our attorneys also met with Deputy Director of China Trademark Office and other officials in charge of opposition cases.

Up to now, our firm has received a total of 28 decisions on these oppositions, in which the Trademark Office ruled that the registration and use of the trademarks filed by Guangzhou Guobang would bring about unhealthy social influence and should not be approved of registration. In the meantime, other members who joined the complaint coalition also received favorable decisions.
