Amendment to Implementing Regulations of
Chinese Patent Law Publicized for Public Comments
The
Legislative Affairs Office under the State Council has publicized the
recommended amendment to the Implementing Regulations of the Patent
Law and its explanatory notes for public comments, which shall be submitted
before March 31, 2009.
According to the recommended version of the Implementing Regulations
for review by the State Council, it includes nine aspects of contents,
that is, titles, patent application documents, patent filing and examination
procedure, patent evaluation report, invalidation procedure, streamlining
of fee schedule and procedure, improvement of compulsory licensing system,
use of patent right, compensation of inventor or designer, protection
of patent right and international applications entering into national
phase and so on.
