Regulations on the Protection of the Right of
Communication through Information Network Shall Be Effective This Year



The National Copyright Administration (NCAC) and the Ministry of Information Industry (MII) have jointly drafted new regulations entitled "Regulations on the Protection of the Right of Communication through Information Network (Regulations)" and they are now holding public consultation on the draft. It is said that new regulations shall be effective in 2006.

It is the first time that China sets norms to enable healthy development of the Internet by formulating legal provisions, which is significant for perfecting the copyright protection system, protecting network IPRs and restraining network infringements.

In accordance with the Copyright Law, the drafted Regulations define fair uses and statutory licenses for the first time by stipulating eight types of network fair uses and statutory licenses of distance education, public library as well as written work, work of fine art or photographic work on networks.
